Bruno Galoppini Felix Universidade de Marília (UNIMAR) RESUMO O objetivo do presente artigo é analisar as possibilidades de intervenção do Estado na ordem econômica, em especial por meio da atividade reguladora, e destacar o risco de captura desta atividade, tanto pelos agentes econômicos, quanto pelo governo. Inicialmente, são apresentadas algumas considerações sobre o liberalismo econômico e, posteriormente, sobre o neoliberalismo para, na sequência, discutir a posição da ordem econômica na Constituição brasileira de 1988. Em seguida é analisada a possibilidade de intervenção do Estado na Ordem Econômica, em especial, por meio de atividade reguladora, sendo apresentados casos em que essa intervenção pode sofrer a “captura”, tanto por entes econômicos, quanto pelo governo. Ao final, utilizando-se do método dedutivo e a partir de uma pesquisa bibliográfica de cunho histórico e exploratório, conclui-se que são necessárias novas medidas visando impedir a captura das agências reguladoras. ABSTRACT This paper aims to analyze the possibilities of State intervention in the economic order, especially through regulatory activity, and also to point the capture risk of this activity, both by economic agents and by the government. Firstly, some considerations about economic liberalism and neoliberalism are presented, to later discuss the position of the economic order in the Brazilian Constitution of 1988. Then, the possibility of State intervention in the Economic Order is analyzed, especially through regulatory activity, and cases are presented in which this intervention may suffer “capture”, both by economic entities and by the government. Finally, using the deductive method and from a historical and exploratory bibliographic research, it is concluded that new measures are needed to prevent the capture of regulatory agencies.
