235 _______________________________________ REVISTA DI@LOGUS ISSN 2316-4034 – Volume 4 nº 2 SIMPLIFICAÇÃO DA LINGUAGEM JURÍDICA COMO FORMA DE APROXIMAÇÃO ENTRE A SOCIEDADE E O DIREITO KEITEL, Ana Luisa Moser 1 ; SOUZA, Antonio Escandiel de 2 ALVES, Carla Rosane da Silva Tavares 3 PIAS, Fagner Cuozzo 4 Resumo: Esta discussão teórica é resultado do projeto de pesquisa intitulado “A simplificação da linguagem jurídica: um estudo sobre a visão da comunidade acadêmica da Universidade de Cruz Alta”, o qual conta com o apoio da Fundação de Amparo à Pesquisa do Rio Grande do Sul (FAPERGS). Esta pesquisa, que ainda não se tem dados em razão do estudo estar em fase inicial, tem metodologia descritiva e possui caráter investigativo com o fim de demonstrar o atual cenário de descrença de grande parte da população na atuação do poder judiciário contraposto à necessidade de simplificação da linguagem jurídica. Tem como base teórica os ensinamentos de Alexandre de Moraes e Luis Warat. Nos deparamos, atualmente, com linguagens profissionais, que constituem-se a partir dos termos técnicos inerentes às profissões. No direito, constituiu-se o chamado “juridiquês”, onde os textos jurídicos, além de serem rebuscados, possuem termos em latim, que tornam-se de difícil entendimento para leigos. O que se condena na linguagem jurídica é o excesso de formalismo, de rebuscamento na ornamentação dos textos. Há a ideia de que o “juridiquês” é o principal responsável pela lentidão dos processos, uma vez que as petições se tornando mais complexas e extensas demandam de mais tempo de análise. Sendo assim, faz-se necessária a simplificação da linguagem jurídica, uma vez que, desta forma, está se protegendo o direito constitucional de acesso à justiça, modificando o atual cenário de descrença de boa parte da população no poder judiciário, que se dá principalmente pela falta de entendimento dos textos jurídicos. Abstract: This theoretical discussion is the result of the research project entitled "Simplifying the legal language: a study of the vision of the academic community at the University of Cruz Alta", which has the support of the Foundation for the Rio Grande do Sul Research ( FAPERGS). This research, which still has no data because the study is at an early stage, has descriptive methodology and has investigative character in order to demonstrate the great current of disbelief scenario of the population in the work of the judiciary opposed the need for simplification legal language. On the right, was the so-called "legalese", where legal texts, and are embellished, have Latin terms, which become difficult to understand for lay people. What is condemned in the legal language is excessive formalism of rebuscamento in the ornamentation of the texts. There is the view that "legalese" is the main responsible for the slowness of the process, once the applications becoming more complex and require more extensive analysis time. Thus, the simplification of legal language it is necessary, since in this way, is protecting the constitutional right of access to justice by modifying the current good disbelief scenario of the population in the judiciary, which mainly gives the lack of understanding of the legal texts.
