An appreciation and a lament

“Crimeswithoutcriminals:WitchcraftanditscontrolinRenaissanceEurope,”published
in the Law & Society Review(Currie,1968).Itfascinatedmethen,anditcontinues
tofascinatemenow.Itisimpressiveformanyreasons;erudition—astudyofwitchcraftinthe
Renaissance;scope—acomparativehistoricalstudythatcoverschangesintwolocations,which
spanmorethanthreecenturies;acknowledgments—HowardBecker,EgonBittner,FredDubow,
DavidMatza,ShellyMessinger,andPhilipSelznick;andtheoreticalmentors—Becker,Erikson,
Kitsuse,Goffman,andLemert.Itisimpressiveindeed.
Intheintroduction,Currie(1968:8)wrote,“Inthispaper,Iattempttoaddtotherather
smallbodyofresearchonkindsofsocialcontrolsystemsandtheirimpact.Thesubjectiswitch-
craftinRenaissanceEurope,andinparticular,thewayinwhichthephenomenonofwitchcraft
wasdifferentinEnglandthaninContinentalEurope,asaresultofdifferencesintheirlegal
systems.”Hethenexplained(1968:8),“IwillshowthattheEnglishandthecontinentallegal
systemsduringthisperiodrepresentedthetwoendsofacontinuumalongwhichdifferent
socialcontrolsystemsmaybeplaced,andIwillsuggestsomegeneralwaysinwhicheachkind
ofcontrolsystemaffectsthedeviantbehaviorsystemsinwhichitisinvolved.”Thearticlegoes
ontotakeusonatourofwitchcraftlawenforcementandtrialproceedingontheContinent
andinEnglandbetweenthe15thand18thcenturiesthatrevealsandexplainswhywitcheswere
muchmorecommonandtreatedmuchmoreharshlyontheContinentthaninEngland.
ButitwasCurrie’s(1968)conclusionsandhisassessmentofthesetopicsthathasinterested
me.Oneconclusionwasthat“witchcraftinRenaissanceEuropestronglyreinforces...the
argumentthatdevianceiswhatoffcialsayitis,andthatdeviantsarethosesodesignatedby
offcials.”Buthisconclusionwentbeyondreconfrmingthiskeyinsightoflabelingtheory.His
studyexaminedvariationsandsoughttoexplainwhywitchcraftaswellastheprosecutionand
