According to normative law with a conceptual approach that refers to relevant legal materials and statutory regulations, it can be concluded that: The legal consequences of default are the provision of compensation, cancellation of agreements, transfer of risk, and payment of court costs. The principle of good faith can be concluded from Article 1338 paragraph (3) of the Civil Code, which reads: "Agreements must be executed in good faith." So Article 1338 paragraph (3) of the Civil Code emphasizes the importance of trust, will or good will and full responsibility of the parties for the agreements they make. 1. PENDAHULUAN Kebutuhan akan tempat tinggal adalah salah satu kebutuhan primer dalam hidup manusia, bersama dengan sandang (pakaian) dan pangan. Dalam Pasal 1 Undang- Undang Republik Indonesia No.1 Tahun 2011 Tentang Perumahan dan Kawasan Pemukiman, “Perumahan adalah kumpulan rumah sebagai bagian dari pemukiman, baik perkotaan maupun perdesaan yang berfungsi sebagai lingkungan tempat tinggal atau lingkungan hunian dan tempat kegiatan yang mendukung perikehidupan dan penghidupan”. Salah satu cara untuk memenuhi kebutuhan akan rumah ialah dengan cara menyewa rumah. Masalah kekurangan tempat tinggal atau perumahan memang menjadi isu yang mendesak di banyak wilayah, terutama di kota-kota besar. Beberapa faktor yang berkontribusi pada masalah ini meliputi : 1. Pertumbuhan Penduduk : Pertumbuhan penduduk yang cepat, terutama di perkotaan, berdampak pada peningkatan kebutuhan akan tempat tinggal.
