First of all, the author analyzes the nature of constitutional identity and key approaches to understanding its essence; then she examines the interrelation of such categories as constitutional identity, and national identity and the relation of the State language to them; finally, she finds out the nature of such interrelations and their impact on the status of the State language under the Constitution of Ukraine. Applying a rational approach, the author establishes that constitutional identity, despite its prevailing negative attitude in Western doctrine, can have a completely positive meaning due to the need to protect national identity. It is established that national identity, as the identity of a community that is the source of constituent power, is the foundation of constitutional identity. The constituent power is realized in the constitution, and thus the elements of national identity (such as language, culture, traditions, symbols, etc.) become components of the constitutional identity. The procedure for adopting a constitution, involving representatives of different groups of the population in the process of its development, discussion, and adoption, makes it an act of constituent power of the political community. However, the identity of the state-forming nation is the fundamental source of constitutional identity. Constitutional identity is the identity of the community that is the subject of constituent power reflected in the constitution (the constitutional text, as well as the values and principles on which it is based). This community is political in nature, but is based on the national identity of the state-forming entity, the exercise of which right to self-determination made possible the existence of a sovereign state in which such a constitution is in force.
