As reflexões de Durkheim, expostas em artigo no ano de 1893, funcionaram como fio condutor das ilações aqui produzidas. Ressaltam-se as críticas de Durkheim que negam e/ou reafirmam as teses basilares presentes nos argumentos de Richard. E, principalmente, explicitam-se os argumentos que sustentam a construção histórica da ideia da arbitragem, da garantia, do delito, da pena e do elemento comum a estas noções constituintes da ideia do direito, ou seja, a solidariedade. Conclui-se que, ao procurar demonstrar que a solidariedade é a essência do direito, o trabalho de Durkheim aqui enfocado apresenta os primeiros ensaios do método empregado pelo sociólogo no campo jurídico. ABSTRACT In this article is discussed the origin of laws idea, on given grounds of Emile Durkheim thoughts, begeted on the criticismo of the book Essai sur l’origine de l’idée de droit, Gaston Richards. The reflections of Durkheim, exposed on the article in the year of 1893, were as the conduct of ilation here producted. Its projected the criticism of Durkheim that denies or reafirm basilar tesis presente on arguments of Richard E., mostly, make explicit arguments that sustaim the historical construction of the arbitrated ideia, of guaranteee, of transgression, of sentence and the common element of this constituting notions by the ideia of law, therefore, solidarity. Consequently concludes, that by looking to demonstrate solidarity the essence of law, the work of Durkheim here enfocade shows the firts essays of the method used by the sociologist in the juridic field.
