The article establishes the relationship between European integration and revitalization of investment processes in higher education; the need for investing in a higher education institution was investigated; a theoretical analysis of the system of investment activity in the field of higher education in the scientific discourse was carried out; the main approaches to the interpretation of the concept of "investment in education" and "educational investment" are outlined; two approaches to the interpretation of investment in education are described (as a process of managing an educational institution and as a process of human capital development); legislative acts affecting investment in higher education are schematically displayed; the model "state - employer - institution of higher education - student" is proposed as a tool for solving the problem of legal regulation of investments in institutions of higher education; problematic aspects of the investment activity of the institution of higher education are listed and considered; Keywords. Вступ У сучасному світі освіта є важливою соціальною структурою, яка забезпечує реалізацію ряду невід’ємних функцій. До таких функцій відноситься навчання, виховання, розвиток, соціалізацію тощо. Забезпечується виконання цих функцій на різних рівнях освіти, зокрема у вищій школі. Важливо зауважити, що існує взаємозв’язок між основними функціями освіти та їх реалізацією через інвестиційну діяльність. Нині інвестиції в освіті можна розглядати з двох сторін. Перший розглядає інвестиції в освіту як управлінський процес залучення додаткових ресурсів задля розвитку закладу освіти, а другий – процес самоменеджменту, який можна охарактеризувати як «вкладання інвестицій в себе» для примноження людського капіталу. На нашу думку в умовах стрімкого реформування системи публічного управління і адміністрування галузі вищої освіти потребує поглиблення дослідження фінансово-правових аспектів адміністрування інвестиціями закладу вищої освіти як управлінського процесу.
