The enforcement of Tommara customary law that developsin Tounwawan Village, Southwest Maluku, is a form of customary law protection that relies on the stability and equality of victims and perpetrators, owing to the fact that Tommara customary law is guided by the valuesand norms that apply in people's lives to see kand find balanced legal justice without causing harm to both the victim and the litigant, it's either the perpetrator or the extended family.The Tommara's costumary law essentially keep the community in social interaction as an aspect of life that occurs together in its dynamic life as a social system that is interdependent with one another,so that unity or continuity is formed, and behavior as alegal reality in society, which we aspire to realizing legal certainty. Customary law practices have evolved in to a positive legal perspective in Indonesian, which specifically requires good social values and norms applied in positive law, that also emphasizes punishment and fines/compensation but also creates a law-order society and does not deviate between customary law and positive law in Indonesia due to injustice and conflict. Abstrak Kata Kunci : Penegakan Hukum, Adat Tommara, Hukum Positif Indonesia DOI : Penegakan Hukum Adat Tommara yang berkembang di Desa Tounwawan, Maluku Barat Daya adalah bentuk perlindungan hukum adat yang menitikberatkan pada keseimbagan dan keadilan pelaku dan korban dikarenakan hukum adat Tommara lebih berpedoman pada nilai-nilai dan norma-norma yang berlaku dalam kehidupan masyarakat untuk mencari dan menemukan keadilan hukum yang seimbang tanpa ada kerugian bagi korban serta pihak yang berperkara, entah itu pelaku ataupun keluarga besarnya.
