59 Gaetano Carlizzi Categorie del multiculturalismo ed ermeneutica giuridica abstract The paper, which investigates the relationship between contemporary law and multi- cultural societies, is divided in two parts. The first part (§§ 1-4) is a meta-theoretical analysis of multicultural categories and it addresses three main issues: Who are the real promoters of cultural identity’s claims? Is every culture necessarily monolithic? Is it possible to belong to different cultures at the same time? While trying to answer the above questions, the paper shows the heterogeneity of intercultural conflicts and the need to manage them in relation to their specific context. In the second part (§§ 5-6) such need is further discussed according to the legal-hermeneutical idea that rules and facts are strictly related to each other and referring to a trial for a culturally motivated crime. keywords Multiculturalism – Identity – Recognition – Legal Hermeneutics – Culturally Moti- vated Crimes. 1. multiculturalismo: un tema contemporaneo «La diversità etnoculturale è storicamente un elemento fondamentale delle società umane; non si può quindi parlare di una specificità delle società moderne» 1 . Questa risoluta osservazione di Patrick Savidan, condivisa da altri autorevoli studiosi 2 , induce innanzitutto a interrogarsi sulle ragioni per le quali è solo nella seconda metà del secolo scorso che la filosofia e le scienze sociali, ispirate a seconda dei casi da finalità descrittive e/o normative 3 , hanno preso ad approfondire i rapporti di convivenza tra soggetti animati da visioni del mondo stridenti, quando non addirittura conflittuali 4 .
