PRIMEIRAS INFERÊNCIAS DA ANÁLISE ECONÔMICA DA PROPRIEDADE INTELECTUAL FIRST INFERENCIES FROM THE ECONOMIC ANALYSIS OF INTELLECTUAL PROPERTY Afonso de Paula Pinheiro Rocha RESUMO O estudo objetiva utilizar o aparato metodológico da análise econômica do direito para analisar características econômicas dos bens imateriais. Dessa análise espera-se obter algumas inferências sobre como deve ser a formatação mais eficiente do sistema de propriedade intelectual. Apresentam-se algumas noções gerais sobre a propriedade intelectual, especialmente quanto a sua natureza jurídica, de propriedade ou de monopólio legal. Após são identificados alguns dos elementos básicos da análise econômica do direito e como sua metodologia pode ser útil na determinação dos efeitos e conseqüências das normas jurídicas. Realiza-se uma análise crítica da forma de proteção intelectual existente frente às peculiaridades econômicas de produção e difusão dos bens imateriais. O trabalho conclui que o sistema de propriedade intelectual deve manter um constante equilíbrio entre a proteção e o acesso da coletividade, sob pena de violar sua destinação constitucional. Na obtenção deste equilíbrio as limitações aos direitos intelectuais devem ser vislumbradas não só como exceções a uma regra de propriedade absoluta, mas como ferramentas a serem utilizadas sempre que necessário para corrigir distorções no sistema. Of that analysis it is expected to obtain some inferences on how to format the most efficient intellectual property system. It presents some general notions on intellectual property, especially regarding its nature, as property or as legal monopoly. After it identifies some basic elements of the economic analysis of law and how its methodology is useful in determining the effects and consequences of legal norms. It makes a critical analysis of the system in light of the economic characteristics of the production and diffusion of immaterial assets. The study concludes that the intellectual property system must maintain a constant balance between protection and access, or otherwise it would violate its constitutional objective. In the pursuit of this balance, the limitations of intellectual property must be seen not as mere exceptions to an absolute property rule, but as tools to be used whenever necessary to correct systems distortions. 805
