stanbul Ticaret Üniversitesi Sosyal Bilimler Dergisi Yıl:5 Sayı:10 Güz 2006/2 s.7-23 4857 SAYILI  KANUNU’NA GÖRE GEÇC  LKS “KAVRAMI TÜRLER VE KOULLARI” ALGUN ÇFTER * / ÖZGE DEMR ** ÖZET 1475 sayılı  Kanunu, esnekleme sonunda ortaya çıkan yeni istihdam türlerine, dolayısıyla da geçici i ilikisine yer vermediinden, bu dönemde geçici i ilikisi öretisel tartımalar ile ekillenmi ve bu tartımalar ekseninde problemler çözülmeye çalıılmıtır. Ancak zamanla Türkiye’nin Avrupa Birliine üyelik perspektifinin netlik kazanması ve üyelik sürecinin önemli bir ayaını oluturan yasaların birlik yasalarına uyumlatırma sürecinin bir parçası olarak,  Kanunu da deimi ve olgu olarak bize yabancı olmayan geçici i ilikisi ancak 4857 sayılı  Kanunu döneminde kanun kapsamına alınmı ve yasal tanımlaması yapılmıtır. Böylece daha önce kanuni bir düzenleme olmadan uygulanan geçici i ilikisi, hukuki dayanaa kavumutur. Anahtar Kelimeler: Geçici i ilikisi “CONCEPT, TYPES AND CONDITIONS” OF TEMPORARY WORK RELATIONSHIP ACCORDING TO LABOR LAW NO. 4857 ABSTRACT As the Labor Law No. 1475 does not give room for the different types of employment arising as a result of flexibility, and thus the temporary work the temporary work relationship has been shaped with the disciplinary debates in this period, and the problems have been sought to be solved in line with these debates. However, the Labor Law has also changed as part of the process through which the perspective of Turkey’s accession to European Union has transformed into a certain quality of tone over time, and of the efforts to make the national acts which constitute an important step of the process of accession compatible with the laws of European Union, and it is not earlier than the period of Labor Law No. 4857 that the concept of temporary work relationship that is in fact not strange to us has been legislated and defined under the terms of law. Thus, the temporary work relationship which has previously been in effect without a legal regulation reached to legal grounds thereof.
