1 TITLE VI OF THE FAMILY CODE PATERNITY AND FILIATION (Father and Child) Introduction Paternity and Filiation is a very important subject in Familiy relations such that the status of children cannot be compromised (Baluyut vs Baluyut, 186 SCRA 506). Filiation is defined as the civil status of the child in relation to his father of mother 1 . Thus, it can be paternity or maternity. While Paternity is the civil status of the father with respect to the child begotten by him 2 . Maternity, on the other hand, is the status of the mother with respect to the child begotten by her. The latter is always subject of an attack and scandal than the former with regard to filiation. Why? Simply because the mother can always ascertain as to whom is the father of the child borne of her in case of dispute in filiation because the nature requires that the child shall be in the womb of the woman for 9 months or over. She knows for instance, how many men she had or having sex with before or during her coverture or cohabitation with her lawful husband or his boyfriend, as the case maybe.
