Abstract The paper 1 analyses the shape and structure of TAW in Germany and discusses the driving forces and obstacles to its use paying particular attention to the recent sig- nificant changes in the institutional framework of TAW since 2003/2004: substantial relaxation of legal restrictions on the one hand and new rules regarding the remu- neration of temp agency workers on the other. However, the legal principles of “equal treatment” and “equal pay” have not reduced wage differentials between TAW and standard employment. The main reason is that the conclusion of collective agree- ments in the TWA sector has deprived the equal pay principle of any effect. More- over, the collectively agreed wages for temp agency workers clearly belong to the low pay segment, at least in the lower wage groups. This suggests that it is questionable whether the new regulations will change the role of TAW and will have an overall positive impact on the job quality of temp agency workers. Additionally, there are early indications that deregulation and low collective wage agreements may increase the pressure on pay levels in other sectors.
