Database and electronic libraries as LILACS, BIREME, Portal de Periódicos CAPES (CAPES electronic library online) and SciELO, were consulted to form a scenario on the subject. The tracking of keywords as sanitation, municipal plans and wastewater, was decisive for the inclusion of material to be searched, as well as the environmental legislation and technical adjustments. INTRODUCTION The Santa Catarina State scenario of supply of services related to wastewater treatment, according to IBGE data [1], for the year 2008 seems to be quite disturbing. According to this document, only 13.5% of homes were covered by wastewater general collector, 35.2% of the municipalities had wastewater disposal system, and only 16.0% of these municipalities had wastewater treatment. This scenario, as observed in earlier diagnoses, made by the Ministério Público Estadual de Santa Catarine - MP/SC (Public Prosecutor of Santa Catarina State) established a civil investigation to determine liability related to the low sanitation rate in the municipalities of Santa Catarina and in an action together with several organs of the government and the society in general, pursuing the improvement of this situation. In 2010, out of the 21 public and civil inquiries demanded by the Itajaí River Basin initiated by the Regional Environmental Prosecutor of Blumenau, resulted in 21 Termos de Ajustamento de Conduta – TAC (Conduct Adjustment Terms) with the following municipalities: Gaspar, Indaial, Ascurra, Itajai, Benedito Novo Brusque, Timbo, Dr. Pedrinho, Navegantes, Balneario Picarras, Rodeio, Apiúna, Balneario Camboriu, Botuverá, Camboriu, Guabiruba, Ilhota, Luis Alves, Penha, Pomerode and Rio dos Cedros. Those TAC essentially aimed at the suitability of the municipality to the guidelines of the National and State Policy on Basic Sanitation, Federal Law Nr. 11,445 / 07 [2] and State Law No. 13.517 / 07 [3], respectively, through the completion of the planning and structuring of the city to the provision of public wastewater treatment services. Currently, these civil investigations and corresponding TAC are being dealt by the Prosecutors in Environmental Regional of Blumenau and Itajaí.
