Abstract
The challenges of globalization and increased corruption
resulted in failed governance and a weakening of political
authority, particularly in those areas of Pakistan which are not
being directly administered by the Central Government. The result
was a dramatic decline in administrative capacity and societal
legitimacy.
Malakand Division consisted of three states and one agency
i.e. Swat, Chitral, Dir and Malakand Agency. Before merging with
Pakistan in 1969 each state had its own rules and regulations.
After this merger, the PATA Regulations (Provincially
Administrative Tribal Area) was implemented and this made the
judicial system from bad to worse. This gave way to the rise of
Tehreek-i-Nifaz-i-Shariat-i-Muhammadi (TNSM). Twenty five
years of civil and proxy wars in Afghanistan and later Taliban
Islamic movement which emerged in Afghanistan in 1995 strongly
impacted on the deteriorating position of Malakand Division. For
