RESUMO O presente artigo mostra como o Sistema de Direitos Fundamentais na Modernidade está estruturado a partir das idéias de liberdade e igualdade e que esse Sistema de Direitos é a forma através da qual se organizaram o Estado e a Política, o público e o privado; e a Constituição, como acopla- mento estrutural de liberdade e igualdade. ABSTRACT This essay shows how the System of Fundamental Rights in Modernity is structured on the ideas of liberty and equality and that such System of Rights is the form through which State and Politics are organized, both public and private; and the Constitution, as a structural coupling of free- dom and equality.
