MODELOS DE AUTONOMIA INDIVIDUAL E ESTADO DE DIREITO EM HEGEL Agemir Bavaresco 1 Sérgio B. Christino 2 Resumo: A autonomia individual emergente manifesta-se apática e insensível em relação às questões coletivas e à realidade social. Fixa-se num consumo ilimitado de bens e serviços, segundo o estilo de vida e a forma de uma individualidade centrada em si mesma. Esse conceito de liberdade, como autodependência ou auto-satisfação, com todo seu potencial destrutivo, conduz-nos ao impacto de uma crise ecológica sem precedentes. Ora, em que medida a mundialização, constituindo-se numa sociedade de indivíduos, apresenta semelhanças e diferenças, por exemplo, com o Estado de Direito, conforme esta figura é tematizada na Fenomenologia do Espírito? Se a autonomia do indivíduo hegeliano passa pelo reconhecimento da pessoa abstrata, pelo sujeito capaz de agir e pelo cidadão organicamente inserido na sociedade civil e no Estado, quais os alcances e limites do reconhecimento numa futura autonomia individual mundializada? Diante dessa inquietação, apresentamos, primeiramente, os modelos antropológicos de autonomia individual subjetiva e os modelos antropológicos de autonomia intersubjetiva. Depois, estudamos a figura do estado de Direito na Fenomenologia de Hegel e, no final, apontamos alguns desafios ao futuro da autonomia em face ao estado de Direito atual. Abstract: The emergent individual autonomy reveals to be apathetic and indifferent facing collective inquiries and social reality. It becomes fixed in a limitless expenditure of goods and services, according to the lifestyle and the form of an individuality centered in oneself. This idea of freedom like self-dependence or self-satisfaction, with all its destructive potential, drives us to the impact of an ecological crisis without precedence. But in what measure the mundialization, being a society of individuals, presents similarities and differences, for example with the State of Law, according as this image is described in Phenomenology of the Spirit? If the hegelian individual autonomy undergoes the abstract person's recognition, the subject able to act, and the citizen organically inserted in the civil society and in the State, what are the reaches and limits of the recognition in a future world-wide individual autonomy? Due to this uneasiness, we present, at first, the anthropological patterns of subjective individual autonomy and the anthropological patterns of inter-subjective autonomy. Afterwards, we study the image of the State of Law in Hegel‘s Phenomenology, and, at the end, we point out some challenges to the future of the autonomy in view of the present state of the Law.
