Este texto analiza cómo la perspectiva de la justicia transicional se ha planteado desde distintos sectores, tanto oficiales como de la ciudadanía, para tratar violaciones graves de derechos humanos en el pasado y en el presente mexicanos, así como los problemas con los que se ha encontrado ese enfoque, especialmente la dificultad para aplicar el Derecho Penal Internacional. Se concluye que el crimen de lesa humanidad es la figura penal internacional idónea para tratar algunas de las violaciones más graves de derechos humanos en México, a pesar de los problemas procesales y materiales con que se toparía, aun hoy, la aplicación de este tipo en el ordenamiento jurídico del país. For this reason, the answer from the Criminal Law must accommodate to that Mexican novelty.
