Taşıma si- gorta sözleşmesi nedeniyle sigortalı ve taşıma sözleşmesi nedeniyle de gönderilen olan alıcının yükte oluşan zıya ve hasarı usulüne uygun olarak taşıyan/taşıyıcıya bildirmesi gerekmektedir. Sigorta sözleşmesinde sigortalı olan alıcının gönderilen sıfatına sahip ol- duğu durumda, taşıma hukuku kuralları gereği yapması gereken bildirim külfetini yerine getirmemesi, sigortacının, taşıyandan/taşıyıcıdan zararı tazmin etmesini zorlaştıracaktır. TTK m. 1472/2 ve TTK m. 1448 ile getirilen yükümlülükler sonucunda sigortalı sigor- tacının halefyetini ihlal etmemek zorundadır. Aksi takdirde gönderilen, sigortacının za- rarını tazmin etmek durumunda kalacaktır. The buyer who has been insured due to the transport insurance contract and who is the con- signee due to transport contract must inform the carrier about the loss and damage in the cargo. In the case where the insuree of the insurance contract has the title of the consignee, the failure to fulfll the notifcation burden due to the transportation law rules will make it more difcult for the insurer to compensate the damage from the carrier. As a result of the obligations imposed by TCC article 1472/2 and TCC article 1448, the insuree must not violate the succession of the insurer.
