However, it is inherently connected with the transfer of data processed by the economic entity to entities that carry out economic activity in third countries. The EU legislator met the concerns re- garding the transfer of personal data to third countries and in Chapter V of the General Data Protec- tion Regulation, established general principles for the transfer of personal data to third countries and international organizations, as well as the scope, nature and permissible means of such transfers. Among the data processing mechanisms indicated by the EU legislator indicated in the third coun- tries, particular attention is paid to the rather poorly described in the literature binding corporate rules, which are of particular importance to business transactions. Wiąże się to jednak nieodłącznie z przekazywaniem danych przetwarzanych przez podmiot gospodarczy do podmiotów, które prowadzą działalność gospodarczą w państwach trzecich. Ten niezwykle istotny problem zauważył również unijny prawodawca, który wskazał w motywie 101. ogólnego rozporządzenia o ochronie danych osobowych 1 , że przepływ danych do państw spoza 1 Rozporządzenie Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w spra- wie ochrony osób fzycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE; dalej jako ogólne rozporządzenie o ochronie danych lub RODO.
