FALACIAS Y ARGUMENTACIÓN EN EL DERECHO * Francisco Díaz Montilla Departamento de Filosofía fdiazmontilla@gmail.com Abstract: This work is an approach to the concept of fallacy distinguishing two different senses: the ordinary and the technical. According to ordinary sense, a fallacy is something that is false; according to the technical (logical) sense, a fallacy is a logically incorrect argument, regardless of wether the involved information is true or false. From this point of view, a fallacy entails a deficiency in argumentation, because it means that the relationship between premises and conclusion is not adequately established and the argument fails in its fudamental purpose. One of the main questions that this work deals with is the sense in which lawyers, judges and magistrates use the term fallacy. So, twenty-one sentences issued by the Supreme Court of Justice of the Republic of Panama were analyzed and the result was that lawyers, judges and magistrates use the term fallacy in ordinary sense. Resumen: Este trabajo constituye una aproximación al concepto falacia en dos diferentes sentidos: el corriente y el técnico. De acuerdo con el sentido corriente una falacia es algo que es falso; de acuerdo con el uso técnico (lógico), una falacia es un argumento lógicamente incorrecto, independientemente de si la información contenida es verdadera o falsa. Desde este punto de vista, una falacia implica una deficiencia en la argumentación, pues la relación entre premisas y conclusión no se establece adecuadamente y el argumento falla en su propósito fundamental. Una de las preguntas fundamentales en este trabajo tiene que ver con el sentido en que los abogados, jueces y magistrados usan el término falacia. Entonces, se analizaron veintiuna sentencias emitidas por la Corte Suprema de Justicia de la República de Panamá, y el resultado fue que abogados, jueces y magistrados usan el término falacia en sentido corriente, no en sentido técnico.
