However, some polemics have arisen in the state administration due to the authority to dissolve these legally registered Societal Organizations granted to the Government. This article is to discover the development of legal politics and constitutionality of authority in dissolving Societal Organizations granted to the Government. The research method employed is qualitative legal research with regulatory, doctrinal, and decisive approaches. The study demonstrates that the authority to dissolve Societal Organizations that previously was in the hand of the Government under the Law No. 8 of 1985, delegated to the Court under the Law No. 17 of 2013, but then revoked again by the Government under the Law No. 16 of 2017. The changes to these norms shows the direction of the legal policy that tends to return become repressive laws and violates the principles of democracy. While, the analysis on constitutionality of the authority has found: Firstly, there has been a violation against the principles of due process of law as provided for in Article 1 clause (3) of 1945 Constitution; Secondly, there has been a violation against the freedom of association as guaranteed by Article 28 and Article 28 E clause (3); Thirdly, it is not appropriate to apply the principle of contrarius actus against Legally Registered Societal Organizations as a legal subject, consequently it is reasonable that Article 62 clause (3) and 80 A Government Regulatiin in place of Law No. 2 of 2017 as set out in the Law No. 16 of 2017 is declared inconstitutional. In the future, it is important for the lawmakers to immediately revise the Law No. 16 of 2017 or the Constitutional Court to pass a conditional constitutional decision to return the authority to dissolve Societal Organizations to the court. Keywords: Legal Policy, Constitutionality, Dissolution, Societal Organization, Freedom of Association ABSTRAK Eksistensi Organisasi Kemasyarakatan (Ormas) merupakan wujud realisasi kebebasan berserikat dan berkumpul. Namun, muncul polemik ketatanegaraan karena pemberian kewenangan menentukan pembubaran Ormas Berbadan Hukum kepada Pemerintah. Artikel ini hendak menemukan perkembangan politik hukum dan konstitusionalitas kewenangan pembubaran Ormas oleh Pemerintah. Metode penelitian yang digunakan adalah penelitian hukum kualitatif dengan pendekatan regulasi, doktrinal, dan putusan. Hasil kajian menunjukan kewenangan pembubaran Ormas, semula ditentukan oleh Pemerintah berdasarkan UU No. 8 Tahun 1985, lalu diputuskan oleh pengadilan berdasarkan UU No. 17 tahun 2013, tapi akhirnya ditentukan kembali oleh Pemerintah berdasarkan UU No. 16 Tahun 2017. Perubahan rumusan norma ini menunjukan arah politik hukum yang bertendensi kembali menjadi hukum represif dan melanggar prinsip demokrasi. Sedangkan, analisis konstitusionalitas kewenangan menemukan: Pertama, terjadi pelanggaran terhadap asas due process of law sebagaimana diatur Pasal 1 ayat (3) UUD 1945; Kedua, terjadi pelanggaran terhadap hak berserikat dan berkumpul sebagaimana dijamin Pasal 28 dan Pasal 28 E ayat (3); Ketiga, tidak tepat menerapkan asas contrarius actus terhadap Ormas Berbadan Hukum sebagai subjek hukum, sehingga sudah seharusnya Pasal
