The interdependence of organism aims to complement each other. Allah SWT as the Creator has created most of the organism in pairs. For example, humans were created for women and men, Allah has set a mate in each of Allah creatures before they even existed in the world. Phenomenon to unite two organism is called marriage. Marriage in Law Number 1 of 1974 defined as an inner and outer bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family based on the One Supreme Godhead. Marriage, according to Islamic Law is a very important phenomenon in human life until marriage is referred to as mitsaqan ghalizha in the Qur'an, which means a very strong or strong contract and carrying it out is a worship. Based on Indonesian Law and the Compilation of Islamic Law which regulates marriage, explain that a husband can only have one wife and vice versa. However, there are some exceptions where a husband can have more than one wife of course with various criteria and conditions. The Religious Courts as the permit to give permission the conditions that allow this activity called polygamy, such as the certainty that the husband is able to guarantee the necessities of life for his wives and children and the guarantee that the husband will treat his wives and children fairly. Religious Courts as institutions that are given the authority to approve is necessary to pay attention to these basics considering the current phenomenon where polygamy is generally only due to the husband's excessive lust without considering other things such as the adequacy of family needs and justice for their wives and children. Injustice that may be caused due to polygamy that is not in accordance with predetermined conditions, is contrary to Islamic Law where Allah in various words and strengthened by various hadiths of the Prophet Muhammad highly upholds the existence of justice. The topics in this article are a) What is the measure of a husband's ability to fulfill family needs in the perspective of Islamic law? How to interpret the concept of fairness as a condition for polygamy in Law Number 1 of 1974 in the Perspective of Islamic Law? To answer these problems, the study in this article uses the approach and characteristic of the normative approach method using library data sources.
