Lalu apakah istri berhak menceraikan suami yang sedang kesulitan dengan alasan terpapar covid-19? Penelitian ini merupakan penelitian pustaka bersifat deskriptif. Hasil penelitian ini menunjukkan perceraian ketika dalam kondisi sulit karena terinfeksi Covid-19 menurut Imam Hanafi tidaklah bermoral dan tidak manusiawi. Istri tidak dapat menggunakan hak fasakh-nya ketika suami tidak dapat menunaikan kewajibannya atau dalam kondisi terpuruk. Alasan Imam Hanafi, (1) suami menafkahi istri semampunya, (2) suami mempunyai hak untuk memperbaiki keadaan sehingga istri perlu bersabar. Hal ini sesuai dengan nilai yang terkandung dalam surat At-Thalaq ayat 7 dan menggunakan metode Istihsan adh-Dharuriyat. Kata Kunci: Fasakh, Covid-19, Imam Hanafi. According to the majority of scholars, the failure to fulfill the rights to support the wife has the right to sue her husband for divorce. Then does a wife have the right to divorce a husband who is in trouble on the grounds of being exposed to Covid-19? This research is a descriptive library research. The results of this study show that divorce when in difficult conditions due to being infected with Covid-19 according to Imam Hanafi is immoral and inhuman. A wife cannot use her fasakh rights when the husband is unable to fulfill his obligations or is in a bad condition. Imam Hanafi's reasons, (1) the husband supports his wife as much as possible, (2) the husband has the right to improve the situation so that the wife needs to be patient. This is in accordance with the values contained in the At-Thalaq verse 7 and using the Istihsan adh-Dharuriyat method. Keywords: Fasakh, Covid-19, Imam Hanafi.
