O objetivo é analisar as condições de possibilidade de emergência das características que a definem e seu uso no sistema penitenciário no Brasil, tendo como pano de fundo a cultura do medo e o contexto econômico neoliberal. Como resultado desta dinâmica social, surgem novas formas de exclusão e instrumentos de ratificação, como o PCL-R que enumera critérios taxativos para definir objetivamente um psicopata, tornando-o um ser diferenciado. Coloca-se em análise o trabalho do psicólogo no sistema penitenciário, hegemonicamente restrito à elaboração de laudos, atingindo o objetivo de excluir uma parcela da população indesejável com um diagnóstico que perdurará por sua vida, favorecendo a perpetuação de processos de criminalização. CONSTRUCTION OF THE CONCEPT OF PSYCHOPATHY IN CULTURE OF FEAR ABSTRACT The article is the result of a bibliographic research and the discussion of concepts and practices about the issue of psychopathy. The goal is to analyze the conditions of possibility of emergence of the characteristics that define it and its use in the penitentiary system in Brazil, in relation to the background of the culture of fear and the neoliberal economic context. As a result of this social dynamic, new forms of exclusion and instruments of ratification appear, as the PCL-R that enumerates specific criteria to define objectively a psychopath, making it a different being. The work of the psychologist in the penitentiary system is analysed, with restricted hegemony to draft reports, reaching the goal of deleting an unwanted portion of the population with a diagnostic that will endure for his or her life, in favour of the perpetuation of processes of criminality.
