Sulis Setyowati Tinjauan Hukum Normatif Terhadap Hasil Eksaminasi... 101 TINJAUAN HUKUM NORMATIF TERHADAP HASIL EKSAMINASI PUBLIK ATAS PUTUSAN PENGADILAN DALAM PERKARA TINDAK PIDANA KORUPSI Sulis Setyowati Dosen Fakultas Hukum Universitas Pamulang E-mail : dosen01106@gmail.com ABSTRAK Eksaminasi publik sebagai upaya untuk mendorong dan memberdayakan partisipasi publik agar dapat terlibat lebih jauh di dalam mempersoalkan proses suatu perkara dan putusan yang dinilai kontroversi dan melukai profesi hukum melakukan penilaian dan pengujian terhadap proses peradilan dan putusan lembaga penegak hukum lainnya yang dirasakan dan dinilai bertentangan dengan prinsip-prinsip hukum dan rasa keadilan masyarakat. Eksaminasi publik diharapkan dapat menjadi pertimbangan bagi Mahkamah Agung, Kejaksaan Agung, dan Komisi Pemberantasan Korupsi dalam melakukan koreksi terhadap kinerja aparaturnya. Hasil eksaminasi tidak bermaksud untuk melakukan intervensi terhadap proses hukum. Namun eksaminasi publik terhadap putusan-putusan pengadilan atau produk hukum yang dianggap menyimpang lebih merupakan sebagai ruang publik yang harus dimulai dibangun agar lembaga-lembaga negara tidak lepas dari kontrol masyarakat sekaligus sebagai bentuk partisipasi masyarakat mengawasi peradilan. Kata Kunci: Eksaminasi Publik, Putusan Pengadilan, Tindak Pidana Korupsi ABSTRACT Public examination as an effort to encourage and empower public participation in order to engage further in questioning the process of a case and the judgment controversy and injure the legal profession to assess and judge the judicial process and other law enforcement decisions that are perceived and judged to be contrary to the principles of principles of law and sense of community justice. Public examination is expected to be a consideration for the Supreme Court, the Attorney General's Office, and the Corruption Eradication Commission in correcting the performance of its apparatus. Examination results do not intend to intervene in the legal process. However, public examination of judicial decisions or legal products that are considered deviant is more of a public space that must be started to be built so that state institutions can not be separated from the control of society as well as a form of public participation overseeing the judiciary. .
