Untuk itu, penulis tertarik menganalisa tentang hak konstitusional fakir miskin terhadap pemerintah di kota Makassar. Bagaimana bentuk hak konstitutional fakir miskin dan anak terlantar, bagaimana keterlibatan pemerintah Kota Makassar di kalangan fakir miskin, dan bagaimana konsep ketatanegaraan Islam terhadap penanganan fakir miskin dan anak terlantar. Jenis penelitian ini merupakan penelitian field research yang menggabungkan antara penelitian hukum normatif dan penelitian hukum empiris. Penelitian ini menunjukkan terdapat bentuk-bentuk hak konstitutional terhadap fakir miskin dan anak terlantar. Keterlibatan pemerintah berupa: menyiapkan tempat tinggal yang layak, pembagian beras sejahtera, pelayanan kesehatan, penyediaan beasiswa dan pembinaan sesuai dengan minat dan bakat. Dalam konsep ketatanegaraan islam, penanganan fakir miskin dan anak terlantar melalui pembagian harta baitul mal. Oleh karena itu, pembinaan yang dilakukan kepada fakir miskin dapat mewujudkan kesejahteraan sosial. Keterlibatan pemerintah dalam membantu dan mengurangi fakir miskin diharapkan pemerintah harus lebih rutin melakukan pendataan tentang fakir miskin agar bantuan yang dilakukan pemerintah tetap sasaran. Kata Kunci: Hak Konstitusional, Fakir Miskin, Pemerintah Daerah Abstract The number of children who are productive age who should be in school, actually live on the streets to find food, busking, begging, and even pickpockets. For this reason, the authors are interested in analyzing the constitutional rights of the poor to the government in the city of Makassar. What are the forms of constitutional rights of the poor and homeless children, how is the involvement of the Makassar City government among the poor, and how is the Islamic constitutional concept of handling the poor and homeless children. This type of research is field research that combines normative legal research and empirical legal research. This research shows that there are forms of constitutional rights for the poor and homeless children. Government involvement in the form of: preparing a decent place to live, distribution of prosperous rice, health services, providing scholarships and coaching in accordance with their interests and talents. In the Islamic state administration concept, the handling of the poor and homeless children through the distribution of the treasury of the mall. Therefore, coaching conducted to the poor can realize social welfare. Government involvement in helping and reducing the poor needs of the government is expected to be more routine in conducting data collection on the poor so that assistance provided by the government remains targeted.
