Through Decision Number 130/PUU-XIII/2015 the Court stated that the phrase “constitutional investigation of this matter to the Public Prosecutor” is conditionally unconstitutional so that the SPDP becomes mandatory to be submitted to the Public Prosecutor, the reported party and the victim/rapporteur no later than 7 (seven) days after the issuance of the warrant. investigation. In practice, the application of this article is still far from the expectations as stated in the Constitutional Court Decision. Abstrak Tujuan dari penelitian ini untuk mengkaji serta menguraikan penerapan pasal 109 ayat (1) Undang-Undang Nomor 8 Tahun 1981 Tentang Hukum Acara Pidana (KUHAP) terkait Surat Pemberitahuan Dimulainya Penyidikan (SPDP). SPDP tersebut disampaikan oleh penyidik kepada penuntut umum guna menjamin penerapan fungsi pengawasan perkara yang dimiliki Penuntut Umum. Melalui Putusan Nomor 130/PUU- XIII/2015 Mahkamah Konstitusi menyatakan frasa “penyidik memberitahukan hal itu kepada Penuntut Umum” inskonstitusional bersyarat sehingga SPDP menjadi wajib diserahkan kepada Penuntut Umum, terlapor dan korban/pelapor paling lambat 7
