Ki Hajar Dewantara 15 A Kota Metro, Lampung Email: imammustofa472@yahoo.co.id Abstrak Perkembangan zaman yang berimplikasi pada lahirnya berbagai fenomena dan persoalan hukum membutuhkan jawaban. Banyak persoalan yang tidak terpenuhi/teratasi oleh aturan hukum Islam dan hukum keluarga di Indonesia. Oleh karena itu, perlu ijtihad kontemporer dalam rangka menjawab berbagai persoalan aktual tersebut. Artikel ini memaparkan tentang urgensi ijtihad kontemporer dalam rangka pembaruan hukum keluarga di Indonesia. Ijtihad kontemporer dilakukan dengan mensinergikan metode usul fikih klasik dengan metode ilmiah modern. Banyak persoalan yang harus diakomodir dalam rangka menghasilkan hukum keluarga yang compitable dengan kehidupan masyarakat modern saat ini, seperti kesetaraan jender, HAM, perkembangan sains dan teknologi modern serta perkembangan sosio-kultural masyarakat. Ada beberapa model ijtihad yang biasa digunakan ulama dalam menjawab permasalahan dalam kehidupan masyarakat. Ijtihad yang paling mungkin dan cocok dilakukan dalam rangka melakukan pembaruan hukum keluarga di Indonesia adalah dengan menggunakan metode mu’tadil mutawa> zin atau metode istis} lah} i> , karena metode ini mempertemukan maslahat menurut nas} s} dan maslahat manusia dalam kehidupan bermasyarakat. Kata kunci: persoalan aktual, ijtihad kontemporer, pembaruan hukum keluarga, maslahat Abstract The advancement in many fields of human life has led to the emergence of law problems which are not covered by the existing laws. So it is the case with the family law in Indonesian context. A contemporary ijtihad is, then, needed to answer those law problems. This article exposes the urgent need of the contemporary ijtihad to redefine the family law in Indonesian context. The contemporary ijtihad is conducted through the combination of classic ushul fiqh method and the scientific modern method. Many problems need to be moderated to generate family law which is compatible with the modern society such as gender issues, human rights, advanced science and technology, and socio-cultural issues. There are several ijtihad methods commonly used by Muslim scholars (ulama) to answer law problems. This writing shows that the most suitable ijtihad method to redefine the family law problems within Indonesian context is mu’tadil mutawa> zin method or the istis} lah} i> method, because this method matches maslahat based on scriptures (nas} s} ) and maslahat found in the society.
