VeJ Volume 4 • Nomor 2 • 304 SISTEM EKONOMI INDONESIA DALAM PERSPEKTIF PANCASILA DAN UNDANG-UNDANG DASAR NEGARA REPUBLIK INDONESIA TAHUN 1945 Agung Rifqi Pratama Pengadilan Negeri Denpasar email: agungrifqipratama@gmail.com disampaikan 22/11/18 – di-review 24/11/18 – diterima 22/12/18 DOI: 10.25123/vej.3067 Abstract The focus of this article, using a juridical normatif and philosophical approach, is in tracking how Article 33 of the Indonesian Constitution is understood and how the Pancasila economic system (based on the five tenets of the State’s ideology) is being implemented by a number of exisitng economic policies. While the Article should be regarded as the embedodiment of Indonesian economic policy, it cannot be denied that the understanding of it evolved and changed following the 4 th amendment to the Constitution. It is observed that the 4 th amendment to the 1945 Constitution have had a great impact on the direction taken by the Indonesian economic policy makers. In using a juridical normative approach we are forced to take the position that Pancasila economic system as found in the Constitution should be followed by the letter in real economic policy making. On the other hand, just to do that, we cannot but realize the need for the existence of government political will. Keywords: 4 th amendment, article 33 of the 1945 constitution, pancasila economic system Abstrak Fokus tulisan ini, yang menggunakan pendekatan yuridis normatif dan filosofis, adalah perkembangan pengertian dan pemahaman atas ketentuan Pasal 33 Undang-undang Dasar Negara Republik Indonesia (UUD NRI) Tahun 1945 yang harus dipandang sebagai kebijakan ekonomi tertinggi di Indonesia. Akan ditelusuri bagaimana pengertian dan pemahaman terhadap ketentuan itu turut berubah bersamaan dengan Amandemen Keempat UUD NRI Tahun 1945 dan bagaimana sistem ekonomi Pancasila diterapkan dalam kebijakan-kebijakan ekonomi yang ada di Indonesia. Ditengarai bahwa dengan adanya Amandemen Keempat UUD NRI Tahun 1945, arah kebijakan ekonomi Indonesia turut berubah. Sekalipun secara normatif-yuridis tetap harus diyakini bahwa Indonesia masih menerapkan sistem ekonomi Pancasila. Argumen utama penulis adalah bahwa sistem ekonomi Pancasila yang terkandung dalam UUD NRI Tahun 1945 bagaimanapun juga harus diterapkan dalam setiap kegiatan perekonomian Indonesia. Pada lain pihak disadari pula adanya kebutuhan akan adanya kehendak politik pemerintah untuk melakukan hal tersebut.
