HUKUK DEVLETİ OLGUSUNUN ESKİ ÇAĞLARDAKİ KÖKENLERİ ORIGINS OF THE RULE OF LAW PHENOMENON IN OLD TIMES Selim MİSAFİR * Özet: Kamu hukukunun temel kavramlarından biri haline gelen hukuk devleti olgusu, tarihsel izdüşümleri ile modern hukuk sistemi- ne ışık tutmaktadır. Düşünsel ve kurumsal kökleri kadim dönemlere kadar uzanan bu olgu, patrimonyal devlet ve polis devleti gibi insan- lığın geçmişten bugüne tecrübe ettiği farklı devlet yönetimi yakla- şımları ile gelişmiş ve Antik Çağ’dan Yeni Çağ’a uzanan bir geçmişin bakiyesi ile devlet kudretinin hukuk ile sınırlandırılmasının aracı ol- muştur. Anahtar Kelimeler: Demokrasi, Hukuk Devleti, İnsan Hakları, Patrimonyal Devlet, Polis Devleti Abstract: The rule of law, which is one of the leading legal the- ories in ensuring social justice and political legitimacy, sheds light on the modern legal system with its historical projections. This pheno- menon, which ideational and institutional origins date back to old times, has developed with diferent state forms such as patrimoni- al state and police state that humanity has experienced from past to present. It is the outcome of the need to limit the state power by law, which emerged as a result of this experience from Ancient Greek to the New Age. The rule of law has become a rising value with the struggles for the establishment of a state where the law is hegemon.
