Tanah Kepada Kantor Pertanahan Selama Pandemi Covid-19

Abstract
This research is discussed by proposing the formulation of the problem what the legal consequences of
the delay in submitting data on the transfer of land rights to the Land Offce in during the Covid-19
pandemic and whether the Covid-19 pandemic conditions were used by PPAT from the obligation
to sue based on force majeure. The research uses the method of approach to legislation/statutes
approach and conceptual approach, a conclusion is obtained: The legal consequences of delays in
PPAT submitting data on the transfer of land rights to the Land Offce as referred to in Article 40
paragraph (1) PP No. 24 of 1997, during the Covid-19 pandemic, the deed of transfer of land rights
still had the power of proof as an authentic deed. PPAT that does not fulfll the obligations as referred
to in Article 40 paragraph (1) P No. 24 of 1997 was subject to administrative sanctions in the form
of a written warning to dismissal from his position as PPAT, as stated in Article 62 paragraph (1) of
PP. 24 of 1997. The condition of the Covid-19 pandemic cannot be used by PPAT from the obligation
to sue based on Force Majeure, because as Article 102 of Permen ATR No. 7 of 2019, the PPAT deed
was submitted to the Head of the Land Offce can be in the form of an Electronic Document. PPAT
ignores the provisions of Article 40 paragraph (1) PP No. 24 of 1997 may give the aggrieved party
the right to claim compensation as stipulated in Article 62 paragraph (2) PP No. 24 of 1997, based
on having committed an unlawful act as referred to in Article 1365 B.W.

Abstrak
Penelitian ini mengajukan rumusan masalah apa akibat hukum keterlambatan PPAT
menyampaikan data-data peralihan hak atas tanah kepada Kantor Pertanahan pada masa
pandemi Covid-19 dan apakah kondisi pandemi Covid-19 digunakan PPAT dari kewajiban
bertanggung Gugat Atas Dasar Force majeur. Penelitian menggunakan metode pendekatan
peraturan perundang-undangan/statute approach dan pendekatan konsep/conseptual approach,
diperoleh suatu kesimpulan: Akibat hukum keterlambatan PPAT menyampaikan data-
data peralihan hak atas tanah kepada Kantor Pertanahan sebagaimana Pasal 40 ayat (1)
PP No. 24/1997, pada masa pandemi Covid-19 terhadap akta peralihan hak atas tanah
tetap mempunyai kekuatan pembuktian sebagai akta otentik. PPAT yang tidak memenuhi
kewajiban sebagaimana Pasal 40 ayat (1) P No. 24 Tahun 1997 dikenakan sanksi administratif
berupa teguran tertulis sampai pemberhentian dari jabatannya sebagai PPAT, sebagaimana
Pasal 62 ayat (1) PP No. 24/1997. Kondisi pandemi Covid-19 tidak dapat digunakan oleh
PPAT dari kewajiban bertanggung Gugat Atas Dasar Force majeur, karena sebagaimana Pasal
102 Permen ATR No. 7/2019, bahwa akta PPAT yang disampaikan kepada Kepala Kantor
Pertanahan dapat berupa Dokumen Elektronik. PPAT mengabaikan ketentuan Pasal 40 ayat (1)
PP No. 24/1997 dapat memberikan hak kepada pihak yang dirugikan untuk menggugat ganti
kerugian sebagaimana ketentuan Pasal 62 ayat (2) PP No. 24/1997, atas dasar telah melakukan
perbuatan melawan hukum sebagaimana Pasal 1365 B.W.
